The following terms and conditions apply to all services offered by Digitalshadow.co.uk, by ordering such services you demonstrate that you are in agreement to the following terms and conditions.

1. We reserve the right to refuse our services if we judge a web site to be unfit by content or otherwise.

Digitalshadow.co.uk forbids the use of offensive material such as pornography. The incitement of hate towards persons belonging to any type of religion, ethnic group, disability or sexual orientation is strictly prohibited.

Web sites will also be refused if they are in breach of copyright or other UK law.

If it is found that the content of a web site in relation to Digitalshadow.co.uk contains one or more of the aforementioned you will be contacted and directed to remove such content. Refusal to remove such material will result in the removal of services by Digitalshadow as we retain the right to do so.

2. All material supplied by the client shall remain the property of the client and will be assumed free to use by the web designer without fear of breach of copyright.

3. All property provided by Digitalshadow such as, html coding, text, images etc will remain copyright Digitalshadow until payment is made in full whereupon they will become property of the client.

4. Digitalshadow reserves the right to change the price of their services at any time without notice. However if a commission has been discussed with the client beforehand it will not be changed and the quote will remain for 28 days.

5. If at any point during website development a client wishes to cancel, they will be invoiced an amount that Digitalshadow feels to be proportional and fair to the amount of work completed on the commission.

6. Digitalshaow will initially place the web site on a demonstration server so that the client may view and comment upon the project. Once the client has approved the project a final invoice will be presented. A site will be hosted once approval of the design and content is received however Digitalshadow reserve the right to remove the site at any time until the invoice is paid in full.

7. Although every effort is made to display the pages acceptably on the browsers currently available, we cannot accept responsibility for pages which don’t display properly on versions of browsers that are released after the project is completed.

8. At project acceptance we can provide an estimated completion date, however we cannot guarantee this date as the final completion date.

9. The acceptance of a quote shall be deemed as a contractual agreement between client and Digitalshadow.co.uk.

10. The client is ultimately responsible for checking the correctness of the site before they give Digitalshadow.co.uk permission to make the site publicly available.

11. All prices include 17.5% VAT.

12. Quotes are valid for 28 days.

13. Customers wishing to cancel a hosting, support or updating package must inform us before the invoice date otherwise full annual payment will be required.

14. Digitalshadow offer annually renewable packages of hosting and updating service agreements which can be purchased as part of a package or separately.
These packages are quoted for either on application or at time of quoting for a full project.

By agreeing to these terms and conditions your statutory rights are not affected.
